Terms of Purchase

The terms “Green Diva” and “Green Diva Jewelry” are used interchangeably throughout this Agreement to refer to Green Diva Enterprises LLC.  Headings in bold are for reference only and do not contain any contractual significance.  The terms “Purchaser” and “Purchasers” are used interchangeably to refer to the individual or individuals that purchased or may purchase a product from Green Diva.  Green Diva reserves the right to add, delete, or modify any provision this Agreement at any time without notice.

“Retailers” refers to any individual or business that buys Green Diva jewelry to resell to the public or to their customers.  “Their customers” , “customers of retailers” or “retailer customers” refers to any individual or business that buys Green Diva jewelry from the Retailer.

Material Sensitivities

Green Diva jewelry is constructed with metals, such as silver, gold, copper, nickel, steel and more.  Sterling, Argentium and Black silver used by Green Diva has an alloy of fine or sterling silver mixed with at least 7.5% other metals.  Gold Vermeil and Pink/Rose Gold Vermeil will contain silver, gold and other metals.  Purchaser agrees to consult a licensed physician or specialist before purchasing or wearing Green Diva jewelry if he/she may have an allergy to or sensitivity toward any metal.

Green Diva jewelry contains other materials, such as gemstones, pearls, organic and vintage/secondhand materials.  Purchaser can request to know the exact materials used in each piece of jewelry by contacting Green Diva at info@greendivajewelry.com.  Purchaser agrees to consult a licensed physician or specialist before purchasing or wearing Green Diva jewelry if he/she may have an allergy to or sensitivity toward any material or dyes.  Purchaser agrees not to wear jewelry near a person with a known sensitivity to metals, gemstones, organic materials or dyes.

Purchaser acknowledges and agrees to apply the same aforementioned precautions and to all products, including jewelry and non-jewelry, sold through Green Diva.

The wearer takes full responsibility for his/her decision to wear Green Diva jewelry and releases Green Diva of all liability from any physical conditions which may arise from doing so.

Retailers purchasing at wholesale agree to take responsibility for informing customers of materials contained within jewelry and agree that Green Diva cannot be held liable for allergic or other reactions experienced on the part of the customer, or individuals the customer has had near physical proximity to, while wearing the jewelry.  Green Diva cannot accept returns or exchanges from customers of retail partners selling Green Diva jewelry.

Safety

Green Diva jewelry is made with metals, gemstones and other materials that may have jagged or sharp edges.  Movement of the jewelry through handling and everyday wear may cause these edges to become unsafely exposed.  Purchaser understands that jewelry is delicate and that forceful, improper or careless handling or misuse, whether by intent or negligence, may damage the goods and become unsafe for wear until repaired.  Purchaser agrees to use caution when handling the jewelry to prevent any alterations to its construction and avoid unsafe conditions. 

Purchaser agrees to closely inspect jewelry before each handling and each wear to ensure that no edges or components can cause harm.  Purchaser agrees to cease from wearing or handling without protective equipment any item that they feel has become unsafe for wear or handling and contact Green Diva at info@greendivajewelry.com immediately for repair. 

If allowing jewelry to be handled or worn by others, Purchaser agrees to supervise babies, children and individuals that may be mentally or physically unable to handle jewelry safely.  Purchaser agrees to use jewelry for wear as a wardrobe accessory and not to use or consume it in any other way; and will ensure the same when supervising jewelry used by others. 

Purchaser acknowledges and agrees to apply the same aforementioned safety precautions and agreements to all products, including jewelry and non-jewelry, sold through Green Diva.

The wearer takes full responsibility for his/her decision to wear Green Diva jewelry and releases Green Diva of all liability from any consequences which may arise from doing so.

Retailers purchasing at wholesale agree to take responsibility for informing customers of safety precautions that should be taken when handling and wearing jewelry, as listed in this section.  Retailers will hold Green Diva harmless for incidents resulting from misinformation, mishandling, improper use or negligence on the part of their customer.

Inclusive

This policy applies to all Green Diva jewelry and other products received by customers and customers of retailers, regardless of whether the item was paid for using cash or credit or whether it was received as a gift or promotional giveaway.  It is the product recipient’s responsibility to contact Green Diva or visit the website and get educated on the proper use and handling of the product before handling or wearing. 

Indemnity

Purchaser, including Retailers, agrees to indemnify and hold Green Diva and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Green Diva arising out of any breach by Purchaser of these Terms of Purchase or other liabilities arising out of Purchaser’s use of Green Diva products; including use by Retailer customers.

Intellectual Property

The Intellectual Property Rights in the Green Diva website, promotional materials and Wholesale Lookbooks and the materials on or accessible via them belong to 'Green Diva' or its licensors. This website, promotional materials and lookbooks, and the materials on or accessible via them and the Intellectual Property Rights therein may not be copied, distributed, published, licensed, used or reproduced in any way (save to the extent strictly necessary for, and for the purposes of, accessing and using this website).

'Green Diva', the Green Diva Logo, Green Diva tagline and Green Diva signature leaf image are trade marks which belong to 'Green Diva Enterprises LLC' and they may not be may not be used, copied or reproduced in any way without written and signed consent from the owner of 'Green Diva Enterprises LLC'.

For these purposes "Intellectual Property Rights" includes the following (wherever and when ever arising and for the full term of each of them): any patent, trade mark, trade name, service mark, service name, design, design right, copyright, database right, moral rights, know how, trade secret and other confidential information, rights in the nature of any of these items in any country, rights in the nature of unfair competition rights and rights to sue for passing off or other similar intellectual or commercial right (in each case whether or not registered or registrable) and registrations of and applications to register any of them.

Wholesale Purchases

Green Diva products purchased by Retailers for resale to their customers and/or the public, must be sold under all applicable state and federal laws.  Products may not be resold at excessive retail prices, which is defined as any retail price that exceeds three times the wholesale rate at which the product was originally sold to the Retailer.  All policies posted to the Green Diva website and/or made available electronically or in print form to the Retailer directly apply to any Green Diva products resold to Retailer customers and/or the public through the Retailer.

Entire Agreement

This policy operates alongside the Website Terms and Conditions, Privacy Policy and Return Policy.  It is highly recommended that all Purchasers access and thoroughly review these documents through the Green Diva website or by contacting Green Diva directly at info@greendivajewelry.com.
